Today’s highlights:
India has amended its 2021 IT Rules to bring deepfakes and other AI-made impersonations under a formal framework, tightening platform duties to provide a clear legal basis for labelling, traceability, and accountability related to synthetically generated information.
Objectives of the Amendments
The proposed amendments seek to:
Clearly define synthetically generated information;
Clarify the applicability of this definition in the context of information being used to commit an unlawful act, including under rules 3(1)(b)&(d) and rules 4(2)&(4) of the IT Rules, 2021;
Mandate labelling, visibility, and metadata embedding for synthetically generated or modified information to distinguish synthetic from authentic content; and
Strengthen accountability of SSMIs in verifying and flagging synthetic information through reasonable and appropriate technical measures.
The changes sharply cut response times, including a three-hour deadline to comply with official takedown orders and a two-hour window for certain urgent user complaints, raising the risk of legal exposure if platforms fail to act. Some synthetic content categories, such as deceptive impersonations and non-consensual intimate imagery, are barred outright, and repeated non-compliance could jeopardize safe-harbor protections. Critics warn the compressed timelines could encourage automated over-removal and weaken due process, while companies face a short runway before the rules take effect on February 20.
