Training AI models requires 𝗺𝗮𝘀𝘀𝗶𝘃𝗲 𝗮𝗺𝗼𝘂𝗻𝘁𝘀 𝗼𝗳 𝗱𝗮𝘁𝗮, often scraped from the web. But is all this online content truly 𝗳𝗿𝗲𝗲 𝘁𝗼 𝘂𝘀𝗲? Microsoft Thinks So!

However, the determination of fair use depends on several factors, including the purpose and character of the use, the nature of the copyrighted work, the amount used, and the effect on the market value. 𝗪𝗵𝗮𝘁 𝗠𝗶𝗰𝗿𝗼𝘀𝗼𝗳𝘁 𝗧𝗵𝗶𝗻𝗸𝘀?
Mustafa Suleyman, Microsoft AI head, suggests that content available on the open web is fair game for training AI models unless explicitly restricted. He believes the norm since the 1990s has been that online content is essentially "freeware" for copying and reproduction. According to Suleyman, unless a publisher or news organization explicitly states "do not scrape or crawl," AI companies can use their content for training models.

𝗟𝗮𝘄𝘀𝘂𝗶𝘁𝘀 𝗔𝗴𝗮𝗶𝗻𝘀𝘁 𝗢𝗽𝗲𝗻𝗔𝗜 𝗮𝗻𝗱 𝗠𝗶𝗰𝗿𝗼𝘀𝗼𝗳𝘁?
Despite Suleyman's stance, several legal challenges have emerged. In May, eight American newspaper publishers, including major newspapers like the New York Daily News and the Chicago Tribune, sued Microsoft and OpenAI for unauthorized use of their articles in AI products. Additionally, the Center for Investigative Reporting (CIR) filed a lawsuit against these companies for using their copyrighted material without permission or compensation. Few examples-

Our 𝗧𝗮𝗸𝗲?
Just because something is online doesn't mean it's freely for all uses to do anything with it. Existing lawsuits against OpenAI claim it used copyrighted material without permission, removed copyright info, reproduced and distributed works, and created unauthorized derivative works which can harm market value of the original work. This can not be ignored. While Microsoft's view on content use is surprisingly too simplistic given the sensitivity of the issue, I highly admire OpenAI's partnerships with major content providers showing a move towards more responsible and cooperative content use.

For those missing the nail-biting drama around California's much hyped upcoming AI Safety Bill (𝗦𝗕-𝟭𝟬𝟰𝟳), here's a brief summary:

Our 𝗧𝗮𝗸𝗲?
While both perspectives are equally important, after reading the requirements in detail I strongly see the need for more RAI experts, ethicists, policymakers, and lawyers to work closely with the AI teams right from the beginning. I am imagining a more balanced approach: 80% responsibility at the application level (especially for fine-tuned models) and 20% at the developer level. This distribution could better balance innovation with safety concerns.

Copyright laws exist for a reason! AI-generated content should not come at the cost of ripping off the original creators.

Major record labels, including Universal, Sony, and Warner, are taking AI music generators Suno and Udio to court over alleged copyright infringement. The labels claim these companies used copyrighted songs without permission to train their AI models that create new music from text prompts. The lawsuit seeks up to $150,000 in damages per infringed work.

Both companies have raised significant funds recently—Suno secured $125 million with a $500 million valuation, and Udio is reportedly generating 864,000 music files daily.

If Suno and Udio get hit hard, it'll be a strong message to all the other AI companies using copyrighted material for model training.

Big News in 𝗔𝗜 𝗠𝘂𝘀𝗶𝗰 𝗖𝗼𝗽𝘆𝗿𝗶𝗴𝗵𝘁 𝗟𝗮𝘄𝘀𝘂𝗶𝘁!

𝗕𝗮𝗰𝗸𝗴𝗿𝗼𝘂𝗻𝗱: Major record labels including Universal, Sony, and Warner sued AI music generators Suno and Udio in June 2024 for alleged copyright infringement, seeking up to $𝟭𝟱𝟬,𝟬𝟬𝟬 per work infringed.

𝗥𝗲𝗰𝗲𝗻𝘁 𝗥𝗲𝘀𝗽𝗼𝗻𝘀𝗲: Suno and Udio have now filed their answers, strongly 𝗽𝘂𝘀𝗵𝗶𝗻𝗴 𝗯𝗮𝗰𝗸 against the claims. They argue their use of copyrighted music for AI training falls under "𝗳𝗮𝗶𝗿 𝘂𝘀𝗲" doctrine. The companies also claim their outputs are new creations, not reproductions of existing songs.

'𝗙𝗮𝗶𝗿 𝗨𝘀𝗲' 𝗶𝗻 𝘁𝗵𝗶𝘀 𝗰𝗼𝗻𝘁𝗲𝘅𝘁: Fair use allows limited use of copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. 𝗧𝗵𝗶𝘀 𝗳𝗮𝗰𝘁𝗼𝗿 𝗶𝘀 𝗺𝗶𝘅𝗲𝗱. The AI companies used entire sound recordings, which typically weighs against fair use. However, they argue they only extracted statistical insights rather than storing the actual recordings, which could potentially favor fair use.

𝗧𝗵𝗶𝘀 𝗳𝗮𝗰𝘁𝗼𝗿 𝗹𝗶𝗸𝗲𝗹𝘆 𝗱𝗼𝗲𝘀 𝗻𝗼𝘁 𝗳𝗮𝘃𝗼𝗿 𝗳𝗮𝗶𝗿 𝘂𝘀𝗲. The AI-generated music could directly compete with and potentially displace the market for the original copyrighted recordings. There's also potential harm to licensing markets for the copyrighted works.

Overall, based on traditional fair use analysis, at least 3 out of 4 factors seem to weigh against fair use. This case will be pivotal in determining how copyright law applies to AI training data. Courts evaluate fair use claims on a case-bycase basis, and the outcome of any given case depends on a fact-specific inquiry.
